Accused’s lawyer urges court to make IG’s clarification part of Noor murder case file

Islamabad-The lawyer of an accused—Asmat Adam Jee—in Noor Mukaddam murder case on Wednesday argued before the court that Inspector General of Police (IGP) Islamabad has interfered in the case by issuing a clarification (press release) regarding an earlier cross-examination of the investigation officer.

He also urged the court to make the clarification part of case file.

Additional and Sessions Judge (ASJ) Atta Rabbani, who was conducting hearing in Noor murder case, asked which clarification and where was it issued? He also remarked, “If any such clarification has been issued by the police, then it’s a bad thing.”

Public Prosecutor Rana Hassan Abbas, on the occasion, stated before court that reports in the media should be left to media. 

Asad Jamal, lawyer of Asmat Adam Jee—an accused and mother of prime accused Zahir Zakir Jaffar raised a question whether the clarifications issued by the Islamabad police regarding Monday’s hearing should be made part of the case. The prosecutor told the judge he would inform him if that was the case and the judge vowed to take action in this regard.

Meanwhile, Advocates Akram Qureshi and Shehzad Qureshi, who were representing Therapy Works employees, conducted the cross-examination of investigation officer Inspector Abdul Sattar

During the cross-examination, the IO was asked about details concerning Amjad Mehmood, an employee of Therapy Works, who was allegedly injured by Zahir when they tried to save Noor from his clutches on the day of the incident. Inspector Abdul Sattar said that Amjad’s statement was not initially recorded as he was in critical condition at PIMS. He added that Amjad was arrested on August 14 and was included in the investigation.

When one of the lawyers asked him whether Section 324 (attempted murder) of the Pakistan Penal Code was added in the FIR against Zahir after recording Amjad’s statement, the IO answered that it was not.

He told the court that Amjad’s medical examination was not conducted and his blood-stained clothes were also not seized by police from the crime scene or the hospital. He added the blood of Amjad was also shed on crime scene and police had not collected the sample. He said crime scene Incharge Muhammad Imran had not seized any laptop. 

According to autopsy report, he said, ASI Muhammad Zubair, lady constable Aqsa Rani and SHO Women reached at the crime scene.

It was also included in the report that the applicant had reached the crime scene before arrival of police, he said adding that police was informed about the murder and he then reached Police Station Kohsar.

He said he did not remember either Raza Muhammad was appointed as duty officer at PS Kohsar. He said that he had not registered FIR in police station as an applicant.

“I had not received information about murder at 9pm then how could he pass on information about it to ASI Basharat Rehman,” said Inspector Abdul Sattar.

He said he was not present at crime scene at 9:30pm and ASI Basharat reached the crime scene after him. He said according to DVR, the employees of Therapy Works had not shifted Zahir to van.

On this, Akram Qureshi Advocate, lawyer of Therapy Works, said police had not mentioned statement of witness Mudassir Aleem.

The IO said he had handed over three parcels containing samples to Muhammad Riaz on July 21 because Farast Fahim was on leave.

Also, Sajjad Ahmed Bhatti, the lawyer of Iftikhar, Jan Muhammad and Jamil, cross-examined IO Abdul Sattar. The IO said nothing was mentioned in the map of police about the main gate of Jaffars house. Similarly, police had not shown the presence of the three accused—servants of Jaffars—in the map. “I and Shaukat Mukaddam had seen the CCTV footage on July 20 and 21,” he said.

He said that the mobile phone of Noor Mukaddam was on from July 18 to 20 and she had not alerted police. According to CD-R, Noor had not alerted any of her near and dear ones about the danger she was facing, he said. He said no eyewitness turned up before police investigators.

On the other hand, Shehzad Qureshi Advoate also cross-examined the IO. He said he wanted to see CCTV footage to ascertain the time of arrival of Therapy Works employees.

Babar Hayyat Advocate requested the court for in-camera proceeding. The video of the crime scene was played in the court sans media men.

Later, ASJ Atta Rabbani adjourned hearing till February 2.
