IHC submits compliance report to SC on removal of illegally constructed structures on state land

ISLAMABAD – The registrar office of Islamabad High Court (IHC) has submitted its compliance report in response to the Supreme Court of Pakistan’s directives regarding removal of illegal constructed structures from the football ground and district courts F-8 Markaz. 

The compliance report stated that the office of IHC Registrar had promptly taken measures to ensure that the order and directions of the apex court are complied with in letter and spirit. 

It added that the Registrar of IHC is bound to implement and comply with the directions of the apex court in letter and spirit and that extreme caution and diligence has been exercised not to leave any stone unturned to ensure compliance of the SC order. 

The SC had said in its order, “We are informed that some structures of the courts have also been erected on the land of football ground/ park and if that be so, the Registrar of the Islamabad High Court, Islamabad shall immediately ensure that such land is vacated, court’s structure removed and the courts are shifted to proper regular premises. In this regard, the Registrar of the High Court shall submit a compliance report to the Registrar of this court within a period of one week.” 

According to the report of IHC registrar, as soon as the order was received by the registrar office, the District Judge and the Capital Development Authority (CDA) were directed to identify any court or structures relating thereto, which may have been constructed on state land in violation of the CDA Ordinance 1960. 

It said that in response to it, the CDA informed that it had been misstated before the apex court that some courts or structures relating thereto had been constructed within the demarcated area of the football ground. 

It added that the CDA, however, informed that some courts and structures were illegally constructed on a public commercial plot. Besides the illegally constructed courts, some chambers on the said plot were also illegally constructed by enrolled advocates. 

It continued, “Since the august Supreme Court had given two months for removal of lawyers chambers, therefore, the Capital Development Authority was informed to proceed in accordance with law only to the extent of removal of those courts or any structure relating thereto, which had been illegally constructed on state land in order to comply with the order of the Supreme Court, whereby the judgment of the Islamabad High Court had been upheld.” 

The report further said that the CDA had promptly taken action and thereafter it had confirmed that the courts or structures relating thereto, which were illegally constructed had been demolished/ removed. 

“The office of the Registrar of the Islamabad High Court had directed an authorised officer to inspect the area and the latter confirmed that the illegally constructed courts and structures relating thereto were demolished/ removed.”
